The Peril Adjusters Process — Forensic Commercial Claims

Seven Steps from Suppressed Claim to Settlement

Every Peril Adjusters engagement follows a documented forensic methodology. We don’t just submit paperwork — we rebuild your claim from the policy outward, document every suppression tactic the carrier used, and produce a supplemental the carrier cannot credibly dispute.

Step 1 — Policy Review & Coverage Audit

Before anything else, we read your policy in full. Commercial policies contain coverage provisions that carrier adjusters routinely ignore: matching material endorsements, business income coverage, ordinance & law provisions, code upgrade requirements, and Prompt Payment Act protections. We identify every applicable provision and build the claim framework around them.

Step 2 — Forensic Re-Inspection

We conduct an independent property inspection with licensed professionals — roofing consultants, structural engineers, or cause-and-origin specialists as needed. We do not rely on the carrier’s scope. We document damage independently, unit by unit, elevation by elevation, using measurement data the carrier cannot simply override.

Step 3 — Independent Scope & Pricing

We build a complete independent estimate using industry-standard pricing tools. Every line item is documented. Every matching material obligation is flagged. Depreciation schedules are reviewed against your RCV endorsement. The scope we produce becomes the basis for your supplemental — not the carrier’s suppressed estimate.

Step 4 — Statutory Coverage Claims

For commercial property claims, we formally invoke applicable state insurance code provisions for matching materials, Prompt Payment Act protections, and business income coverage where applicable. These are statutory rights your carrier is obligated to honor in writing. Most policyholders never raise them. We raise all of them on every eligible claim.

Step 5 — Supplemental

We prepare a formal supplemental — a documented legal claim for the difference between the carrier’s offer and what the policy owes. This document must meet evidentiary standards. It includes our independent scope, pricing support, policy citations, matching material documentation, and depreciation analysis.

Step 6 — Negotiation & Prompt Payment Enforcement

We negotiate directly with the carrier’s adjuster and, if escalated, their legal team. Carriers who delay payment without a valid reason may be subject to statutory interest plus attorney’s fees under applicable state law. We use this leverage actively. Most commercial claims reach negotiated resolution within 30–90 days of our supplemental submission.

Step 7 — Settlement

What the carrier calls a settlement, we call the result of forced capitulation.

By the time we reach Step 7, the carrier has been presented with a forensic documentation package they cannot responsibly dispute. Every line of damage has been measured, photographed, modeled, and mapped against your policy’s coverage language. Every code upgrade has been identified and valued. Every secondary loss, every business interruption figure, every statutory deadline has been tracked and enforced.

The carrier does not settle because they have become generous. They settle because continuing to resist a fully documented, legally compliant, professionally prepared claim becomes more expensive than paying what is owed. That is not negotiation. That is the architecture of inevitable recovery — and we build it deliberately, from the first inspection forward.

The final check reflects the difference between what the carrier initially offered and what your policy actually owed. That gap — closed through forensic rigor and statutory leverage — is the only number that matters. It is what we were engaged to produce, and it is what we deliver.

The Two-Year Window

Nationwide, you have a limited window from the date of loss to reopen and supplement a commercial claim. If your claim settled without forensic documentation — no matching material enforcement, no business income claim, no depreciation challenge — there is very likely additional recovery available. The review is free.
